WVDoc Service Process

Our telehealth services follow a secure 3-step process:

• Step 1: Complete contact form on our landing page (no PHI collected)
• Step 2: Complete secure HIPAA-compliant intake form via Jotform
• Step 3: Payment via Stripe and appointment scheduling

Payment is taken prior to scheduling; refunds per service policy.

Emergency Situations

WVDoc is not intended for emergency medical situations. In case of a medical emergency:

• Call 911 or your local emergency services immediately
• Go to the nearest emergency room
• Contact your healthcare provider's emergency line
• Do not use our platform for urgent medical needs

Telemedicine Limitations

Termination by WVDoc

We may suspend or terminate your account if you:

Effect of Termination

Upon termination:

• Your access to our services will be immediately suspended
• You may request a copy of your medical records
• We will retain your data as required by law and our retention policies
• Outstanding fees and obligations remain due
• Certain provisions of these Terms will survive termination

11. Disclaimers and Warranties

No Warranties

Maximum Liability

Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to WVDoc in the 12 months preceding the claim.

State Law Variations

Some states do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless WVDoc, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

14. Dispute Resolution

Binding Arbitration

If informal resolution fails, any disputes will be resolved through binding arbitration rather than in court, except for:

Arbitration Rules

• Arbitration will be conducted by the American Arbitration Association
• The arbitration will take place in Charleston, West Virginia

Class Action Waiver

You agree that any arbitration will be conducted on an individual basis only and not as a class action, collective action, or representative proceeding.

15. Governing Law

These Terms of Service and any disputes arising from or related to our services will be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles.

Any legal action or proceeding not subject to arbitration will be brought exclusively in the state or federal courts located in Kanawha County, West Virginia, and you consent to the jurisdiction of such courts.
